Terms and conditions for using Scripter

1. Acceptance of Terms

By creating an account, accessing, or using Scripter ("Service", "Platform", "Application"), you ("User", "you", "Veterinarian") agree to be bound by these Terms of Service ("Terms", "Agreement"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Scripter ("we", "us", "our", "Company") regarding your use of:

  1. Full Application: The veterinary prescription management platform available at app.scripter.au
  2. Free Prescription Generator: The free prescription creation tool available at scripter.au/free-prescription-generator

1.1 Two Service Options

Full Application (app.scripter.au):

  • Requires account creation and professional verification
  • Stores prescription data securely on our servers
  • Provides full prescription management features
  • Subject to all terms in this agreement

Free Prescription Generator (scripter.au/free-prescription-generator):

  • No account required
  • Does NOT store data on our servers (browser-only processing)
  • Limited to single prescription creation
  • Subject to professional responsibility requirements (Section 1.2) and acceptable use policies (Section 4)
  • You are responsible for saving and storing generated prescriptions

2. Eligibility and Professional Requirements

2.1 Professional Qualifications (All Users)

To use any Scripter service (including the free prescription generator), you must:

  • Be a currently licensed and registered veterinarian in Australia
  • Hold a valid veterinary registration with a State or Territory veterinary board (NSW, VIC, QLD, SA, WA, TAS, NT, or ACT)
  • Be in good standing with your veterinary regulatory authority
  • Maintain current professional indemnity insurance
  • Comply with all applicable Australian veterinary regulations and professional standards

Important for Free Prescription Generator Users:

  • While we do not verify your credentials when using the free tool, you represent and warrant that you meet all professional qualifications
  • You accept full professional and legal responsibility for all prescriptions created
  • Misrepresenting yourself as a veterinarian may result in legal consequences

2.2 Verification Process (Full Application Only)

Users of the full application (app.scripter.au) must complete professional verification before accessing prescription features:

  • You must provide accurate registration information including your veterinary registration number and issuing state/territory
  • You must upload valid verification documents, which may include:
    • Current veterinary registration certificate
    • Government-issued identification
    • Other professional credentials as requested
  • Scripter reserves the right to verify your credentials with relevant veterinary regulatory authorities
  • Verification typically takes 1-3 business days
  • Scripter may reject verification or request additional documentation at its sole discretion
  • Providing false or misleading information during verification may result in immediate account termination and potential reporting to regulatory authorities

2.3 Account Registration

By creating an account, you represent and warrant that:

  • All registration information you submit is accurate, current, and complete
  • You will maintain and update your information to keep it accurate and current
  • You are legally authorized to use the name and registration details provided
  • You will not create an account on behalf of another person without authorization
  • You have only one Scripter account (duplicate accounts are prohibited)

2.4 Age Requirement

You must be at least 18 years of age to use this Service. By using Scripter, you represent that you meet this age requirement.

3. Account Security and Responsibilities

3.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials (email and password)
  • All activities that occur under your account, whether or not authorized by you
  • Using a strong, unique password that meets our security requirements (minimum 8 characters with uppercase, lowercase, number, and special character)
  • Not sharing your login credentials with any other person or entity
  • Ensuring that you log out from your account at the end of each session, particularly on shared computers

3.2 Notification of Unauthorized Access

You must immediately notify us at info@scripter.au if you:

  • Become aware of any unauthorized access to your account
  • Suspect a security breach
  • Believe your credentials have been compromised

We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate your account immediately and without prior notice if:

  • You violate these Terms
  • You engage in professional misconduct
  • Your veterinary registration is suspended, revoked, or expires
  • You provide false or misleading information
  • You use the Service in a manner that could harm patients, clients, or the veterinary profession
  • We are required to do so by law or regulatory authority
  • Your account remains inactive for more than 24 months

3.4 Effect of Termination

Upon termination:

  • Your access to the Service will be immediately revoked
  • You remain responsible for complying with applicable record retention requirements
  • We will retain prescription data in accordance with our legal obligations and your professional requirements (minimum 2 years as required by NSW Health and other state regulations)
  • You may request export of your prescription data as PDF files (subject to verification of your identity)
  • You may request account deletion from your Account page under the Security tab, or by contacting info@scripter.au

4. Acceptable Use and Prohibited Conduct

4.1 Permitted Use

You may use Scripter only for lawful purposes, including:

  • Creating legally compliant veterinary prescriptions for patients under your care
  • Managing and organizing prescription records
  • Exporting prescription documents in PDF format
  • Maintaining patient and client records as required by law

4.2 Prohibited Activities

You must not:

  • Share your account credentials or allow others to use your account
  • Create prescriptions for animals you have not personally examined or for which you do not have a valid veterinarian-client-patient relationship (VCPR)
  • Issue prescriptions that do not comply with Australian veterinary regulations or state-specific requirements
  • Use the Service to prescribe controlled substances in violation of applicable law
  • Create fraudulent, inaccurate, or misleading prescriptions
  • Modify exported prescriptions by hand (handwritten alterations to printed prescriptions are prohibited by regulation)
  • Use the Service to compete with or replicate its functionality
  • Reverse engineer, decompile, or attempt to extract the source code
  • Introduce viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use automated systems (bots, scrapers) to access the Service
  • Transmit spam or unsolicited communications through the Service
  • Violate any applicable local, state, federal, or international law
  • Infringe on intellectual property rights
  • Impersonate another person or veterinarian

4.3 Professional Standards

You acknowledge and agree that:

  • Scripter is a tool to assist in prescription management; all clinical decisions and professional responsibilities remain yours
  • You are solely responsible for ensuring prescriptions are clinically appropriate and legally compliant
  • You must maintain compliance with:
    • Australian Pesticides and Veterinary Medicines Authority (APVMA) regulations
    • State and territory veterinary practice acts
    • Australian Veterinary Association (AVA) professional standards
    • Relevant pharmacy regulations
  • You remain professionally liable for all prescriptions created using Scripter

5. Service Description and Availability

5.1 Service Features

Full Application (app.scripter.au) - Currently provided free of charge:

  • Secure prescription creation with guided and freeform entry modes
  • Patient and client record management
  • Prescription history and search functionality
  • PDF export of individual prescriptions
  • Professional profile management
  • Secure storage of prescription data

Free Prescription Generator (scripter.au/free-prescription-generator) - Always free:

  • Single prescription creation without account
  • Instant PDF generation and download
  • Browser-only processing (no data stored on servers)
  • No login or verification required
  • Limited to one prescription at a time

5.2 Service Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any feature of the Service at any time
  • Impose limits on certain features or restrict access to parts of the Service
  • Change from a free service to a paid subscription model (with reasonable notice)
  • Migrate the platform to different hosting infrastructure
  • Update the user interface and functionality

We will provide reasonable notice of material changes, but are not obligated to maintain any specific feature indefinitely.

5.3 Service Availability

While we strive for continuous availability:

  • The Service is provided on an "as available" basis
  • We do not guarantee uninterrupted or error-free operation
  • Scheduled maintenance may temporarily interrupt access (we will provide notice when possible)
  • Unexpected downtime may occur due to technical issues
  • We are not liable for losses resulting from service unavailability

We aim for 99.9% uptime but do not provide service level guarantees at this time.

5.4 Current Free Service Model

Scripter is currently provided free of charge. However:

  • We reserve the right to introduce subscription fees or other charges in the future
  • If we implement paid subscriptions, we will provide at least 30 days' notice to existing users
  • Existing users will have the opportunity to export their data before any transition to paid service
  • Account migration may be required if we change hosting platforms

6.1 Record Retention Requirements

You acknowledge and agree that:

  • All prescriptions must be saved to the patient's medical record
  • Veterinary records, including prescriptions, must be retained for at least 2 years from the date of creation (as required by NSW Health and other state regulations)
  • Some states may require longer retention periods; you are responsible for knowing and complying with your state's requirements
  • Medical records must clearly indicate when prescriptions are issued
  • You are responsible for maintaining compliant record-keeping practices

Important for Free Prescription Generator Users:

Since the free prescription generator does NOT store prescriptions on our servers, you are solely responsible for:

  • Downloading and saving the generated PDF immediately
  • Storing the prescription in your practice management system or medical records
  • Ensuring the prescription is retained for the legally required minimum period (2+ years)
  • We cannot retrieve, recover, or provide copies of prescriptions created with the free tool
  • Failure to save and store prescriptions may result in non-compliance with veterinary regulations

You confirm that for each prescription created using Scripter:

  • You have performed an appropriate clinical examination of the patient
  • A valid veterinarian-client-patient relationship (VCPR) exists
  • You have made an appropriate diagnosis based on clinical findings
  • The client has been informed of the treatment plan
  • Potential side effects and risks have been discussed with the client
  • Informed consent has been obtained for the prescribed medications
  • The prescription will only be dispensed by a registered pharmacist or veterinarian in accordance with Australian law

6.3 Prescription Requirements

You agree that prescriptions created using Scripter will:

  • Comply with all applicable Commonwealth, state, and territory regulations
  • Not be altered by hand after printing (handwritten alterations to printed details are prohibited)
  • Contain accurate and complete information as required by law
  • Be issued only for legitimate veterinary purposes

6.4 Regulatory Compliance

You are solely responsible for ensuring compliance with:

  • Agricultural and Veterinary Chemicals Code Act 1994 (Cth)
  • Therapeutic Goods Act 1989 (Cth)
  • State and territory poisons and controlled substances legislation
  • State veterinary practice acts and regulations
  • Privacy Act 1988 (Cth) and Australian Privacy Principles
  • Any other applicable laws and professional standards

7. Intellectual Property Rights

7.1 Ownership of Service

Scripter and all its content, features, and functionality (including but not limited to software, text, graphics, logos, icons, images, and the selection and arrangement thereof) are owned by Scripter and are protected by Australian and international copyright and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your professional veterinary practice, subject to these Terms. This license does not include any right to:

  • Modify, copy, or create derivative works
  • Reverse engineer or attempt to extract source code
  • Distribute, sell, or commercially exploit the Service
  • Use the Service for any purpose other than creating prescriptions for your veterinary practice

7.3 User Content Ownership

You retain all ownership rights to the prescription data, patient records, and other content you create using Scripter ("User Content"). However, by using the Service, you grant us a limited license to:

  • Store and process your User Content to provide the Service
  • Create backups for data protection and disaster recovery
  • Use aggregated, anonymized data for service improvement and analytics (no personally identifiable information will be shared)

8. Data Ownership and Portability

8.1 Your Data

You own all prescription data, patient records, and other content you create using Scripter. We act as a data processor on your behalf.

8.2 Data Export

Currently, you may:

  • Export individual prescriptions as PDF documents
  • View and print all your prescription data through the application interface

Limitations:

  • Bulk data export functionality is not currently available but is planned for future releases
  • Data export to CSV, JSON, or other structured formats is not currently available

8.3 Account Deletion and Data Removal

Account Deletion:

  • You can request account deletion from your Account page under the Security tab
  • Alternatively, you may contact info@scripter.au to request account deletion
  • Upon receiving a verified deletion request, we will:
    • Retain prescription data for the legally required minimum period (2 years from date of prescription)
    • Delete or anonymize personal profile information after verification requirements are met
    • Delete verification documents after retention requirements are satisfied
    • Permanently delete your account and associated data once legal retention periods expire

Data Retention After Deletion: We retain certain data as required by:

  • Australian veterinary record retention laws (minimum 2 years)
  • Legal obligations and regulatory requirements
  • Legitimate business interests (fraud prevention, dispute resolution)

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Scripter, you consent to the collection and use of information as described in the Privacy Policy.

10. Third-Party Services

10.1 Third-Party Dependencies

Scripter relies on third-party service providers for certain functionality:

  • Supabase (database and authentication services)
  • Vercel (hosting and infrastructure)
  • Resend (email notifications)
  • Cloudflare (DNS and content delivery)
  • Cloudinary (CDN and media delivery)
  • Google Analytics (analytics and usage insights - may be used)
  • Vercel Analytics (performance monitoring - may be used)

Your use of the Service is also subject to these providers' terms of service and privacy policies.

10.2 Third-Party Integrations

Scripter does not currently integrate with external pharmacy systems, medical databases, or other third-party veterinary software. Any future integrations will be subject to additional terms and your consent.

10.3 No Endorsement

References to third-party products, services, or websites do not constitute our endorsement. We are not responsible for the content, accuracy, or practices of third parties.

11. Payment Terms and Future Pricing

11.1 Current Free Service

Scripter is currently provided free of charge with no subscription fees, payment processing, or billing.

11.2 Future Pricing

We reserve the right to:

  • Introduce subscription tiers and pricing in the future
  • Charge fees for premium features or services
  • Implement usage-based billing

If we introduce paid subscriptions:

  • Existing users will receive at least 30 days' advance notice
  • We will clearly communicate pricing, billing terms, and payment methods
  • Users will have the option to continue using the Service under the new terms or discontinue use and export their data
  • We may offer grandfathering or discounted rates for early adopters

11.3 Taxes

If fees are introduced, you will be responsible for all applicable taxes (including GST) unless you provide a valid tax exemption certificate.

12. Disclaimers and Limitations of Liability

12.1 No Medical Advice

Scripter is a prescription management tool only. It does not provide medical, veterinary, or clinical advice. All clinical decisions are solely your responsibility as a licensed veterinarian.

12.2 "As Is" Service

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, SCRIPTER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties that defects will be corrected

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW:

We are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of goodwill or reputation
  • Professional liability arising from your use of prescriptions created with Scripter
  • Errors or omissions in prescription content (you are responsible for accuracy)
  • Service interruptions, data loss, or security breaches
  • Actions of third-party service providers
  • Your violation of laws or professional standards

Maximum Liability: If we are found liable for any damages, our total liability shall not exceed the greater of:

  • AUD $100, or
  • The amount you paid us in the 12 months preceding the claim (currently $0)

12.4 Professional Liability

You acknowledge that:

  • You remain professionally and legally responsible for all prescriptions created using Scripter
  • Scripter does not validate clinical appropriateness of prescriptions
  • You must independently verify all prescription information before issuing
  • We are not liable for professional negligence, malpractice, or regulatory violations arising from your use of the Service

12.5 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition, right, or remedy implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. If any such provision applies, our liability is limited to (at our option):

  • Re-supply of the service, or
  • Payment of the cost of re-supply

13. Indemnification

You agree to indemnify, defend, and hold harmless Scripter, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of professional standards or regulations
  • Professional liability or malpractice claims related to prescriptions created using Scripter
  • Your infringement of any intellectual property or other rights
  • Your provision of inaccurate or misleading information
  • Unauthorized use of your account due to your failure to maintain security

This indemnification obligation survives termination of these Terms and your use of the Service.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.

14.2 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at info@scripter.au to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.

14.3 Arbitration

If informal resolution is unsuccessful, disputes may be referred to arbitration in accordance with the Australian Centre for International Commercial Arbitration (ACICA) Arbitration Rules, with the arbitration taking place in Sydney, New South Wales.

14.4 Class Action Waiver

To the extent permitted by law, you agree that disputes will be resolved individually, and you waive any right to participate in a class action or representative proceeding.

15. Changes to Terms

15.1 Right to Modify

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify you via email to your registered email address (if material changes affect your rights or obligations)
  • Post a notice on the Service dashboard
  • Provide at least 30 days' notice for material changes that adversely affect your rights

15.2 Acceptance of Changes

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree to modified Terms, you must discontinue use of the Service.

15.3 Version History

We maintain a version history of these Terms. You may request previous versions by contacting info@scripter.au.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scripter regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision unless acknowledged in writing.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

16.5 No Agency

These Terms do not create any agency, partnership, joint venture, employment, or franchise relationship between you and Scripter.

16.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, strikes, internet failures, or acts of government.

16.7 Survival

Provisions that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitations of liability, and indemnification) will survive termination of these Terms.

16.8 Notices

All notices to Scripter must be sent to info@scripter.au.

We will send notices to you via the email address associated with your account.

16.9 Language

These Terms are drafted in English. If translated, the English version prevails in case of conflict.

BY CREATING AN ACCOUNT OR USING SCRIPTER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
